Lack of Concentration lead to Consequences in Cobb County

On 10/03/2021 two vehicles were involved in a collision in Lane 4 on the I20 West.


Officer N T Malagon was dispatched to the scene and ascertained that Mr. Tony Fountain and Mr. Michael Fain had collided in heavy afternoon traffic. Mr. Fountain had not noticed that the traffic had come to a standstill, and rear-ended Fain’s Buick.


Both vehicles sustained minor damage to the front and rear ends, respectively. Fountain did not suffer any injuries, but Fain complained of neck and teeth pain.


Officer Malagon cited Mr. Fountain under O.C.G.A code 40-6-49, which states “The driver of a motor vehicle shall not follow another vehicle more closely than is reasonable and prudent, having due regard for the speed of such vehicles and the traffic upon and the condition of the highway."

Drivers are advised to take particular care in heavy traffic conditions, as slow-moving or stationery vehicles ahead may not be visible. A lack of concentration or a distraction by talking to another person or reaching for something can cause a driver to lose control, even momentarily.
